Services rendered by Genious Communications are subject to the following general conditions, which the buyer states accede without limitation or qualification as soon as he submits an order to Genious.net

The order form available online is an integral part of this contract. Any order of one or more online services implies acceptance of this contract.

ARTICLE 1 : OBJECT

This contract is to define the terms and conditions under which Genious Communications offers its clients its products available on the website http://www.genious.net

This contract is subscribed for a period of one year, from the date of effective on-line publishing of the service .It is renewable by right by one-year period.

The payment of the royalty must be received by Genious Communications at the latest one week before the end of each dead line.

Any non-payment or delay of payment from the client causes an automatic break of the present contract and suspension of the account.

Genious Communications reserves the right to break this contract at any time and without notice, subject to the send an mail to the client (at the address given at the moment of ordering).

In the case of non-payment or a default to the use policy, Genious Communications have the right, without notice and immediately to suspend the client’s account by refunding unused balance of payment.

In the case of violations of use policies of the service, the customer's account may be suspended without refund .

ARTICLE 2 : Products

Client’s area

Following the validation of a product, the customer will be asked to complete a form that will give him access to a personalized interface to manage the products ordered on the web site (access to domain names, access panel, Expiration date of products, invoices ,...)

Hosting

Genious Communications provides to the client, the hosting of a domain name and disk space involved, upon payment of a rental whose cost is based on the product chosen by the customer.

The customer can choose the domain name (Web address), insofar as it is available and in accordance with the Charter of the namespace extension chosen.

The customer has complete freedom concerning the contents of its web space, as far as it conforms to laws and regulations in his country.

In particular, it is prohitbited to publish any form of content associated directly or not:

• To pornography
• to eroticism in all its forms
• to pedophilia
• To pirated programs
• To racism
• To MP3 format and derivatives subject to copyright
• To gambling online (electronic casinos, etc…..)
• To peer to peer software (Kazaa, eDonkey, etc.)
• To illegal activities
• to an IRC network and / or IRC Bots

Genious Communications reserves the right at any time and without notice, to off-line content that it deems not in conformity with laws and regulations in its country.

ARTICLE 3 : Client’s responsibility

The customer must maintain a valid email address and mailing address. The information will be updated by the client from the area conceived on this purpose.

The client has to undertakes Genious Communications in case of non-renewal of the provision of accommodation, within a period of 15 days before the renewal date of the service. If the client does not advise us before the renewal date, the invoice is payable by the customer.

3.1 - Using scripts CGI/PHP/ASP :

Genious Communications provides hosting packages that allow the use of CGI scripts, ASP, PHP and other executable programs. These scripts use much more system resources than simple pages PHP, so there are certain restrictions in the use of these features.

Scripts must use acceptable system resources. Scripts that use a large number of CPU cycles and a large RAM memory space will be suspended or additional charges may be applied.

Genious Communications will make efforts to notify customers using scripts using a too large percentage of system resources before suspending them;

However, if the scripts are causing problems for other clients or that they take too many resources, they can be stopped without notice.

Each pack accommodation should not use more than 2% of system resources (3600 hits / hour) for a period of more than 5 seconds.

Scripts must not interact with the server configuration or hardware. The execution of such scripts may cause the immediate cancellation of the account without refund.

Using your pack to provide metering services or other CGI / ASP / PHP to a large number of people is subject to prior approval by Genious Communications.

3.2 - Using the PHP/MySQL:

The customer is warned that misuse (or based on incorrect programming) to MySQL and PHP (scripting loop, persistent connection, etc..) may make inconsistent operation of the site on a shared server, and display the site to a suspention without notice in order to ensure an acceptable quality of service to all customers of the server.

ARTICLE 4 : Genious Communications’ responsibility

4.1 - Content :

Genious Communications does not control on the content posted by the customer, either through its web space or letters which would be sent

Genious Communications can't be held responsible in any case for any action or claims of a third parties, especially:

• Information, sounds, images, text and multimedia documents contrary to the laws and regulations, content and / or broadcasted on the web space by the client.
• The violation of intellectual property rights relating to the works contained or disclosed in whole or in part on the client's web space.

4.2 - Accessibility :

Genious Communications undertakes to provide all care and diligence necessary for the provision of quality service

Genious COMMUNICATIONS committed to:

• Provide access to content via the Internet 24/24 and 7 / 7 every day of the year. In case of absolute necessity, Genious COMMUNICATIONS reserves the right to interrupt the server for a technical intervention to improve its functioning. Genious Communications will inform before, to the extent possible, the Customer within a reasonable time, informing him of the nature and duration of the intervention, so that the customer should make arrangements.
• Respond quickly to incidents.

4.3 - Security :

Responsibility for Genious Communications can not be held liable for malicious introduction on the web client or a piracy mailboxes of the client and this, despite all the security measures taken by Genious Communications

4.4 - Force majeure :

Genious Communications will not be liable for any delay or failure when the cause of the delay or failure was due to the occurrence of an event of force majeure customarily recognized by the jurisprudence.

The force majeure suspends the obligations of this contract throughout its duration.

However, if the force majeure had a lifetime exceeding 30 consecutive days, it would open the right to terminate automatically this contract by either party eight days after sending a letter with return receipt notifying such decision .

ARTICLE 5 : TERMINATION

1. Any failure or delay of payment from the client leads to automatic break of this contract. The customer may cancel his subscription before the term informing Genious Communications by writing. Such termination does lead any refund.
2. Every part can end the contract in the date of anniversary of its effectiveness by letter, by respecting a notice of one month.
3. Any termination of dedicated server needs to be done by mail and telephone, 30 days before the due date of renewal, any break of this rule entails the payment of sums due to the renewal date .

ARTICLE 6 : JURISDICTION

The price of web hosting and services offered are listed on the website http://www.genious.net.

Prices are ex VAT and payable in Dirhams, Euros and dollars. The price of services paid in advance is guaranteed for the concerned period.

Genious Communications reserves the right to pass without delay any new tax or any increase in the rates of existing taxes.

Only the Moroccan courts are competent to resolve disputes.

Genious Communications offers its clients its products available on its website http://www.genious.net

This contract is entered into for a period of one year from the effective date of launch of your product.

It is renewable automatically for one-year period. Payment of the annual fee must be received by Genious Communications at least 48 hours before each due date.

Any failure or delay of payment from the customer will result in an automatic break of this contract.

In the case of non-payment, failure to use policies, Genious Communications have the right, without any notice and immediately suspend the customer's account by redeeming the unused balance of payment.

For violations of use policies of the service, the customer’s account may be suspended without refund.
